This Privacy Policy explains how TalkingMachines OÜ (registry code 17503863, VAT EE102985162, Roosikrantsi 8c, Tallinn, 10119, Estonia — "we", "us") collects and processes personal data when you use our websites and the eterial.ai Service. We are the data controller for this processing.
1. What we collect
- Account data: name, email address, and credentials you provide when you register.
- Billing data: prepaid balance, transaction history, and limited payment metadata. Card details are processed by our payment provider; we do not store full card numbers.
- Usage data: API requests and responses, chat messages, model and feature usage, timestamps, and similar records needed to operate and bill the Service.
- Technical data: IP address, device and browser information, and cookies (see our Cookie Policy).
- Communications: messages you send us, such as support requests.
2. Why we process it (legal bases)
- To provide the Service — performance of our contract with you.
- To bill and prevent fraud or abuse — performance of contract and our legitimate interests.
- To secure and improve the Service — our legitimate interests.
- To comply with legal obligations — including accounting and tax law.
- With your consent — for non-essential cookies and any optional communications, where required.
3. AI processing
When you use the Service, your inputs are processed to generate output. We use this data to operate the Service. We do not sell your personal data, and we do not use your inputs or outputs to train foundation models without a separate legal basis or your consent.
4. Sharing
We share personal data only with service providers that help us run the Service (for example, hosting, compute, and payment processing), under appropriate agreements, and where required by law or to protect our rights. Some providers may process data outside the EU/EEA; where they do, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses.
5. Retention
We keep personal data only as long as needed for the purposes above, including the life of your account and any period required by law (for example, accounting records). We then delete or anonymize it.
6. Your rights
Under the GDPR you may request access to, correction of, deletion of, or restriction of your personal data; object to certain processing; request portability; and withdraw consent at any time. 7. Security
We use reasonable technical and organizational measures to protect personal data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Children
The Service is not directed to children under 18, and we do not knowingly collect their personal data.
9. Changes
We may update this Policy from time to time and will post the updated version with a new "Last updated" date.
